Chapter 97

א שאם נטע והבריך והרכיב מותר
1 that if one planted [a nut which is orlah] or bent it under the ground or grafted [a young shoot which is orlah on an old tree], [the fruit it grows] is permitted!
ב וכי תימא שני ליה לר' יוסי בין שאר איסורין לעבודת כוכבים ומי שני ליה והתניא שדה שנזדבלה בזבל עבודת כוכבים וכן פרה שנתפטמה בכרשיני עבודת כוכבים תני חדא שדה תזרע פרה תשחט ותניא אידך שדה תבור ופרה תרזה
2 And should you say that R. Yose distinguishes between cases of idolatry and other prohibitions, does he really make this distinction? Has it not been taught: A field which has been fertilized with manure derived from an idolatrous source or a cow that has been fattened on vetch derived from an idolatrous source: One tanna teaches that the field may be sown and the cow slaughtered, while the other tanna teaches that the field must lie fallow and the cow grow lean?
ג מאי לאו הא ר' יוסי והא רבנן לא הא ר"א והא רבנן
3 Is it not, then, that the former is that of R. Yose and the latter that of the Rabbis? No, the former is that of R. Eliezer and the latter that of the rabbis.
ד הי ר"א ורבנן אילימא ר"א ורבנן דשאור
4 Which R. Eliezer and rabbis? If I say it is [the dispute] between them with regard to leaven,
ה דתנן שאור של חולין ושל תרומה שנפלו לתוך העיסה לא בזה כדי לחמץ ולא בזה כדי לחמץ ונצטרפו וחימצו
5 for we have taught: Ordinary leaven and terumah leaven which fell into dough, and in each there was an insufficient quantity to cause leavening, but together they caused leavening:
ו ר"א אומר אחר האחרון אני בא וחכ"א בין שנפל איסור לכתחלה ובין שנפל איסור לבסוף אינו אסור עד שיהא בו כדי לחמץ
6 R. Eliezer says: I follow whichever [leaven went into the dough] last. But the sages say: Whether the prohibited leaven fell in first or last, [the dough] is not prohibited unless it is of a sufficient quantity by itself to cause fermentation.
ז ואמר אביי לא שנו אלא שקדם וסילק את האיסור אבל לא קדם וסילק את האיסור אסור
7 And Abaye explained: The teaching [of R. Eliezer] only applies when he first removed the prohibited leaven but if he did not first remove the prohibited leaven, [the dough] is prohibited.
ח וממאי דטעמא דר"א כדאביי דלמא טעמא דר"א משום דאחר אחרון אני בא אי גמיר באיסורא אסורה ואי גמיר בהיתירא מותרין בין סלקיה ובין לא סלקיה
8 But how do we know that the reasoning of R. Eliezer is like that suggested by Abaye; perhaps his reasoning is because he follows the last thing, and thus if the last thing was forbidden, it is forbidden, and if the last thing is permitted, it is permitted, whether he removed [the prohibited substance] or did not.
ט אלא ר"א ורבנן דעצים
9 Rather it is the R. Eliezer and the rabbis concerning the wood [of an Asherah];
י דתנן נטל הימנה עצים אסורה בהנאה הסיק בה את התנור חדש יותץ ישן יוצן אפה בו את הפת אסורה בהנאה
10 for we have learned: If one took pieces of wood from it, they are forbidden to be used. If he heated a new oven with them, it must be broken into pieces. [If he heated] an old oven with them, it must be allowed to cool. If he baked bread [in an oven so heated], it is forbidden to be used,
יא נתערבה באחרים כולן אסורות בהנאה ר"א אומר יוליך הנאה לים המלח אמרו לו אין פדיון לעבודת כוכבים
11 and if [the loaf] became mixed with other loaves, they are all prohibited. R. Eliezer says: Let him throw an equivalent amount to his benefit into the sea.
יב רבנן דפליגי עליה דר"א מאן נינהו
12 [The Sages] said to him: There is no redemption for idolatry.
יג אילימא רבנן דעצים אחמורי מחמרי
13 The rabbis who disagree with R. Eliezer, who are they? If I say it is the rabbis in the mishnah about the wood, they take the stricter view!
יד אלא רבנן דשאור אימר דשמעת להו לרבנן דמקילי בשאור בעבודת כוכבים מי מקילי
14 Rather it must be the rabbis [who spoke] about the leaven. But say that you have heard that the Rabbis take a lenient view in connection with leaven, but are they lenient with regard to idolatry!
טו אלא לעולם הא רבי יוסי והא רבנן
15 Rather, one baraita is R. Yose's and the other is the rabbis.
טז ר' יוסי לדבריהם דרבנן אמר להו לדידי זה וזה גורם מותר
16 And R. Yose was responding to the words of the rabbis, saying to them: According to my opinion, when there are two causes the product is permitted;
יז לדידכו דאמריתו זה וזה גורם אסור אודו לי מיהת אף ירקות בימות הגשמים
17 but according to you who hold that when there are two causes the product is prohibited, admit to me that [the planting of] vegetables in winter [is prohibited]!
יח ורבנן כדאמר רב מרי בריה דרב כהנא
18 But the rabbis [would reply] as R. Mari son of R. Kahana stated.
יט אמר רב יהודה אמר שמואל הלכה כרבי יוסי: ההוא גינתא דאיזדבל בזבלא דעבודת כוכבים שלח רב עמרם קמיה דרב יוסף א"ל הכי אמר רב יהודה אמר שמואל הלכה כרבי יוסי:
19 Rav Judah said in the name of Shmuel: The halakhah agrees with R. Yose. There was a garden fertilized with the manure obtained from an idolatrous source. R. Amram sent to R. Joseph. He replied to him: Thus said Rav Judah in the name of Shmuel: The halakhah agrees with R. Yose.
